In a small claims case you cannot serve the papers yourself, and they must reach the defendant well before the hearing. LegalServeX serves small claims papers across Orange County.
For personal service of the plaintiff’s claim, allow at least 15 days before the hearing in the same county, or 20 days outside it. For substituted service, allow at least 25 or 30 days respectively. Different rules can apply to a defendant’s claim. The proof of service is filed with the court at least five days before the hearing.
Order early. If your hearing is close, choose Priority or Rush and tell us the hearing date so dispatch can confirm the timing before assignment.
The person serving must be at least 18 and not a party to the case. The court clerk can also mail the claim for a fee, but a process server gives you a dated record of each attempt.
Up to four attempts, a GPS and photo record for each, and a signed proof of service in your portal, ready for you to file.
